Expert Conference "Effective Legal Redress - The Consumer Protection Instruments of Actions for Injunction and Group Damages Action" – co-financed by the European Commission,
Vienna, 24 February 2006

On 24 February, an Expert Conference on the topic of consumer protection through action for injunction and class action will take place in Vienna. The enforcement of consumer protection legislation has been a prime objective of consumer protection policy since the late 90s. In 2001, the directive 98/27/EG on legal action for obtaining an injunction for the protection of the interests of consumers in the Member States has  been implemented by the national legislatures. It is in the year 2006 that the European Commission intends to publish its report on the practical application of the directive.

In Austria, the instrument of legal action for injunction has been successfully used by the pertinent consumer protection institutions for many years.

However, there is still no comprehensive overview regarding the legal and practical indications of the directive in all the Member States. This is why Austria, in preparation of its Presidency, has commissioned a study so that an overview of this study can be presented at the conference together with concrete examples from individual Member States about the corresponding situation.

The second part of the event deals with consumer class actions for damages.

Trade practices which cause a lot of damage to consumers produce grave problems when it comes to individual cases of law enforcement, since this produces a massive overburdening of the courts through individual law suits in substantially identical cases, and causes considerable costs for the individual consumer. These problems could be avoided with the help of an efficient class action instrument. Some Member States already have such provisions.

The objective of the Conference is to organize an exchange of experiences and opinions on this topic as well as provide an overview about the various different possibilities of finding solutions.
